Regulated Gambling for Korean Citizens 

The introduction of regulated gambling came gradually. Horse racing was legalized first, managed by the Korea Racing Authority, as a way to fund public projects and support the sports sector. This was followed by the creation of the lottery system under the Lottery Fund Act, which allowed lottery ticket sales to contribute directly to government programs and rural affairs. 

Sports betting was later introduced through Sports Toto under the National Sports Promotion Act, with oversight from the Korea Sports Promotion Foundation. These systems were designed not as commercial gambling markets, but as controlled fundraising tools with stringent regulations and betting limits. 

Gambling for Foreign Visitors and The Development of Kangwon Land Casino 

Land-based casino gambling was developed primarily for tourism. Foreigner-only casinos were established in major cities to attract foreign visitors, while access for citizens of South Korea remained prohibited. The creation of Kangwon Land Casino marked a unique exception.

Built near abandoned mines, it was intended to support economic recovery in underdeveloped regions rather than expand the gambling sector nationwide. To this day, it remains the only casino legally accessible to South Korean residents.

South Korea Gambling Laws and Betting Regulations

In general, gambling is prohibited for South Korean locals. Gambling for monetary or property gain is considered a criminal act under South Korean law, with only a few narrowly defined exceptions. These exceptions exist under specific legislation such as the National Sports Promotion Act, the Lottery Act, and the Tourism Promotion Act. 

Foreign visitors, however, are permitted to participate in casino gambling at licensed casinos. This distinction between citizens and foreigners is a core principle of betting regulations in South Korea. 

South Korea’s gambling laws are enforced through the Criminal Act and overseen by multiple government bodies and relevant authorities. The National Gambling Control Commission works alongside the Korean government, local authorities, and other government stakeholders to monitor the gambling industry and prevent unlawful gambling. 

Under Article 246 of the criminal law, unlawful gambling can result in fines or imprisonment. Habitual gambling may lead to penalties of up to three years in prison, along with substantial fines. These penalties apply even when South Koreans gamble overseas, under the Habitual Overseas Gambler Law.

Habitual Overseas Gambler Law

The Habitual Overseas Gambler Law allows South Korean authorities to prosecute citizens of Korea who regularly gamble abroad. Even legally betting in other countries may be treated as a criminal offense if deemed habitual. 

This law highlights South Korea’s aggressive stance on gambling addiction prevention and responsible gambling enforcement. 

Online Gambling Regulations in Korea

South Korea enforces some of the strictest online gambling laws in the world. Online gambling, online betting, and online casino participation are illegal for citizens, regardless of whether the online casino platforms are operated abroad. 

Financial transactions linked to illegal sports betting or online gambling are closely monitored. Banks and payment providers may block or report suspicious online gambling-related transactions, and identity verification is required for all lawful gambling activities. 

Legal Gambling Activities in South Korea 

Despite strict regulations, some forms of gambling are allowed by law and are tightly controlled by the government.

Casino Gambling and the Casino Industry

South Korea has a small but regulated casino industry. There are several land-based casinos, but almost all operate only for foreigners. Well-known venues include Seven Luck Casino and other casinos located in major tourist districts.

Kangwon Land Casino is the only casino legally accessible to South Korean citizens. Bicycle Racing and Motorboat Racing

Bicycle racing, motorboat racing, and boat racing are permitted gambling activities designed to promote national sports. These activities are regulated by the Korea Sports Promotion Foundation and other stakeholders. 

Boat racing, bicycle, and motorboat racing betting tickets are sold at authorized locations, and sales are closely monitored. Online betting for these activities is prohibited. 

Sports Betting and Sports Toto

Sports betting is legal only through Sports Toto, operated under the National Sports Promotion Act. Sports Toto allows betting on approved sports such as football, baseball, basketball, volleyball, golf, and traditional Korean wrestling.

Illegal sports betting outside Sports Toto is considered unlawful. Fixed-odds sports betting platforms, international sportsbooks, and foreign betting sites are illegal for South Korean citizens. 

Lottery Tickets and the Lottery Sector

South Korea operates a national lottery system under the Lottery Act. Legal lottery products include House Lotto and other national lottery draws. Tickets are sold through licensed operators, and winnings are taxed. Lottery revenue supports public projects and rural development.

Illegal Gambling in South Korea

Illegal forms of gambling include online gambling, illegal sports betting, unlicensed casino platforms, and unauthorized ticket sales. Participation in illegal gambling can lead to criminal charges, asset confiscation, and imprisonment.
